OVERVIEW

Welcome to Purplexd. The terms “we,” “us,” and “our” refer to Purplexd. Purplexd operates this website and online store, including the information, content, features, products, and services made available through it (collectively, the “Services”).

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products and Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you visit our website, place an order, or otherwise use our Services.

If you do not agree to these Terms, please do not use the Services.

SECTION 1 — ELIGIBILITY, ACCOUNTS, AND CUSTOMER INFORMATION

By using the Services, you represent that you are at least the age of majority in your state or place of residence, or that you are using the Services with the permission and supervision of a parent or legal guardian.

When browsing our store or placing an order, you may be asked to provide information including your name, email address, billing information, payment information, personalization details, and shipping address.

You agree to provide information that is accurate, current, and complete. You are responsible for reviewing your order information before submitting it, including product selections, sizes, colors, quantities, personalization, and shipping details.

If you create an account, you are responsible for maintaining the confidentiality of your login information and for activity conducted through your account. You may not sell, transfer, assign, or license your account to another person.

SECTION 2 — PRODUCTS, MOCKUPS, AND PRODUCT VARIATIONS

We make reasonable efforts to display and describe our products accurately. However, colors may appear differently depending on your device, screen settings, lighting, garment dye lot, and other factors.

Product photographs, lifestyle images, digital mockups, and size charts are provided to help you understand the product. Mockups are visual representations and may not show the exact scale, color, texture, or placement of the finished product.

Because many Purplexd products are printed or made after an order is placed, minor variations may occur in:

  • Print size or placement

  • Garment color or dye lot

  • Fabric texture

  • Product measurements

  • Positioning of personalized elements

These normal production variations are not considered defects.

Garment measurements are approximate and may vary within standard manufacturing tolerances. Customers are responsible for reviewing the size chart provided with the product before ordering.

When a specific garment brand or style is not identified in the product listing, Purplexd may use a comparable garment with similar material, fit, color, and quality if the originally intended garment is unavailable. We will not knowingly make a substitution that materially changes the product without contacting you.

Product descriptions, product availability, colors, sizes, and other details may be changed or discontinued without notice.

SECTION 3 — MADE-TO-ORDER AND PERSONALIZED PRODUCTS

Many Purplexd products are made or printed specifically for the customer after an order is placed. Production may begin shortly after payment is received.

For personalized products, you are responsible for providing complete and accurate personalization information, including names, dates, spelling, capitalization, numbers, and requested wording.

Unless the product listing specifically states that a proof will be provided, orders may be produced using the information submitted at checkout without sending a separate proof.

Purplexd is not responsible for errors contained in customer-submitted personalization information. If we notice an apparent error or missing information, we may contact you for clarification, but we are not obligated to independently verify the information you submit.

If you submit text, artwork, logos, photographs, or other materials for use on a product, you represent that you own those materials or have permission to use them. You agree not to submit content that infringes another person’s intellectual-property, privacy, publicity, or other legal rights.

We may refuse or cancel a personalized order containing unlawful, threatening, hateful, defamatory, infringing, or otherwise inappropriate content.

SECTION 4 — ORDERS AND ORDER ACCEPTANCE

Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges that we received your order but does not guarantee acceptance or fulfillment.

Purplexd may accept, decline, limit, or cancel an order when reasonably necessary, including because of:

  • Product or material unavailability

  • Incorrect pricing or product information

  • Suspected fraud or unauthorized payment

  • Incomplete personalization information

  • Shipping restrictions

  • Violation of these Terms

Payment must be authorized before an order can be processed.

If we cancel an order after payment has been collected, we will issue a refund for the canceled portion of the order using the original payment method.

We may limit or cancel quantities that appear to have been ordered by resellers, distributors, or unauthorized commercial buyers.

SECTION 5 — ORDER CHANGES AND CANCELLATIONS

Please review your order carefully before submitting it.

Requests to change or cancel an order should be sent to jennifer@purplexd.com as soon as possible. Because many products are made to order, we cannot guarantee that a change or cancellation can be completed after production has started, materials have been ordered, or an order has entered fulfillment.

A request is not considered approved until Purplexd confirms the change or cancellation in writing.

Additional charges may apply when an approved change requires new materials, reprinting, redesign, or reproduction.

Nothing in this section limits any cancellation or refund rights provided by applicable law.

SECTION 6 — PRICES, PROMOTIONS, AND PAYMENT

Prices, discounts, and promotions may change without notice. The price charged will be the price displayed when the order is submitted, subject to correction of clear pricing errors.

Unless otherwise stated, displayed prices do not include shipping charges, applicable taxes, customs duties, import fees, or other charges that may apply to the order.

Promotional offers may have separate eligibility requirements, expiration dates, exclusions, or other terms. If promotional terms conflict with these Terms, the promotional terms will control for that promotion.

Discounts cannot be combined unless expressly stated.

You agree to provide complete and accurate payment and billing information. You represent that you are authorized to use the selected payment method and agree to pay all applicable charges associated with your order.

SECTION 7 — SHIPPING, PRODUCTION, AND DELIVERY

Many Purplexd products require production time before shipment. Production time and carrier transit time are separate.

Any production, shipping, or delivery dates displayed on the website or provided in an order communication are estimates unless expressly stated otherwise.

Holiday ordering deadlines are based on expected production and carrier performance. An advertised order-by date does not guarantee delivery when an order contains incomplete personalization, an incorrect address, payment issues, requested changes, or other customer-caused delays.

Purplexd is not responsible for carrier delays, severe weather, service interruptions, customs processing, natural disasters, or other circumstances outside our reasonable control.

If we learn that we cannot ship an order within the promised timeframe, we will notify the customer and provide the options required by applicable law, which may include agreeing to a revised shipment date or canceling the affected items for a refund.

Customers are responsible for providing a complete and accurate delivery address. Additional shipping charges may apply when an order must be reshipped because the customer supplied an incorrect or incomplete address.

SECTION 8 — RETURNS, EXCHANGES, DAMAGES, AND ORDER PROBLEMS

Returns, exchanges, replacements, and refunds are governed by our Refund Policy:

If an item arrives damaged, defective, misprinted, or different from what was ordered, please contact jennifer@purplexd.com promptly and include:

  • Your order number

  • A description of the problem

  • Clear photographs showing the item and issue

  • A photograph of the packaging when shipping damage is involved

Do not mail an item back without first receiving return instructions. Unauthorized returns may not be accepted or processed.

Nothing in these Terms limits any rights that cannot legally be waived.

SECTION 9 — ERRORS, INACCURACIES, AND AVAILABILITY

Occasionally, the Services may contain typographical errors, incorrect prices, inaccurate descriptions, unavailable variants, incorrect shipping charges, or other omissions.

We reserve the right to correct inaccurate information, update product details, or cancel an affected order. If an order is canceled because of an error, we will refund the canceled portion of the order.

We do not guarantee that every advertised product, size, color, or quantity will remain available.

SECTION 10 — INTELLECTUAL PROPERTY

The Services and their contents—including Purplexd’s name, logos, designs, graphics, photographs, videos, product descriptions, website copy, and page layout—are owned by or licensed to Purplexd and are protected by applicable intellectual-property laws.

You may use the Services only for personal, noncommercial purposes.

Unless you receive prior written permission from Purplexd, you may not reproduce, copy, modify, distribute, sell, resell, publish, display, download, scrape, or create derivative works from any portion of the Services or their content.

Nothing in these Terms grants you a license or ownership interest in Purplexd’s intellectual property or the intellectual property of Shopify or another third party.

Purplexd’s names, logos, product names, designs, and slogans may not be used without prior written permission.

SECTION 11 — FEEDBACK, REVIEWS, AND CUSTOMER CONTENT

If you submit a product review, photograph, comment, suggestion, or other content to Purplexd, you represent that you own the content or have permission to submit it.

You grant Purplexd a nonexclusive, worldwide, royalty-free license to use, reproduce, edit, publish, display, and share that content for operating, improving, and promoting the Services.

We are not required to keep submitted feedback confidential, compensate you for it, or publish or respond to it.

Customer content must not:

  • Violate another person’s intellectual-property, privacy, or publicity rights

  • Contain knowingly false or misleading statements

  • Contain unlawful, threatening, defamatory, obscene, or abusive material

  • Contain malicious code

  • Misrepresent the identity of the person submitting it

We may remove customer content that violates these Terms or is otherwise inappropriate for the Services.

SECTION 12 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES

The Services may provide access to tools, payment processors, applications, or services operated by third parties.

Third-party tools and services are provided under the terms established by their respective providers. Purplexd does not control those providers and is not responsible for their independent acts, omissions, security practices, or content.

Your use of an optional third-party tool is at your own discretion and may be subject to additional terms and privacy policies.

SECTION 13 — THIRD-PARTY LINKS

The Services may contain links to websites or content operated by third parties.

Purplexd is not responsible for reviewing or guaranteeing the accuracy, availability, safety, or practices of third-party websites. Accessing a third-party website is at your own risk.

Questions or disputes regarding a third party’s products, services, or content should be directed to that third party.

SECTION 14 — RELATIONSHIP WITH SHOPIFY

Purplexd is powered by Shopify, which enables us to provide the Services to you. However, purchases made through our store are transactions directly between you and Purplexd.

Shopify is not responsible for any aspect of sales between you and Purplexd, including any injury, damage, loss, refund, replacement, or dispute arising from a product purchased from Purplexd.

To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising from or related to purchases and transactions with Purplexd.

SECTION 15 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy:

Because the Services are hosted by Shopify, Shopify processes certain information about your access to and use of the Services. Information may also be shared with service providers that help us process payments, fulfill orders, communicate with customers, prevent fraud, analyze store performance, or operate the Services.

SECTION 16 — PROHIBITED USES

You may use the Services only for lawful purposes.

You may not use the Services to:

  • Violate any applicable law or regulation

  • Infringe Purplexd’s rights or the rights of another person

  • Submit false, fraudulent, or misleading information

  • Harass, threaten, abuse, defame, or harm another person

  • Transmit malware, viruses, or harmful code

  • Collect another person’s information without authorization

  • Send spam, phishing messages, or unauthorized solicitations

  • Impersonate another person or organization

  • Interfere with the operation or security of the Services

  • Circumvent access restrictions or security features

  • Copy, scrape, extract, sell, or exploit the Services or their content without permission

We may suspend or terminate access to the Services if we reasonably believe these Terms have been violated.

SECTION 17 — TERMINATION

We may suspend or terminate your access to the Services if you violate these Terms, misuse the Services, engage in fraudulent activity, or create a risk of harm or liability.

Termination does not eliminate payment obligations or other responsibilities that arose before termination.

Provisions that are intended by their nature to survive termination will remain effective, including provisions relating to intellectual property, customer content, disclaimers, limitation of liability, indemnification, and governing law.

SECTION 18 — DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis.

Except for obligations expressly stated in these Terms, our Refund Policy, or applicable law, Purplexd does not make additional express or implied warranties regarding the Services.

We do not guarantee that the website will always be uninterrupted, secure, error-free, or available.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent legally permitted.

SECTION 19 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, Purplexd and its owners, employees, affiliates, contractors, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the Services or purchase of a product.

This includes, where legally permitted, loss of profits, revenue, savings, data, opportunity, or other similar losses.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

SECTION 20 — INDEMNIFICATION

You agree to indemnify and hold harmless Purplexd, Shopify, and their respective affiliates, owners, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable legal fees arising from:

  • Your material breach of these Terms

  • Your violation of applicable law

  • Your violation of another person’s rights

  • Content or materials you submit through the Services

We will provide reasonable notice of an indemnifiable claim and may control its defense and settlement. You agree to reasonably cooperate with that defense.

SECTION 21 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed if necessary.

The remaining provisions will continue in effect.

SECTION 22 — WAIVER AND ENTIRE AGREEMENT

Purplexd’s failure to enforce a provision of these Terms does not waive its right to enforce that provision later.

These Terms and the policies referenced in them constitute the entire agreement between you and Purplexd regarding the Services and replace prior agreements or communications concerning the same subject.

SECTION 23 — ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without Purplexd’s prior written consent.

Purplexd may assign or transfer its rights and obligations in connection with a business sale, reorganization, change in ownership, or transfer of the Services.

SECTION 24 — GOVERNING LAW

These Terms and any separate agreements through which Purplexd provides Services will be governed by the applicable laws of the United States and the state in which Purplexd is headquartered, without regard to conflict-of-law principles.

Any dispute that may lawfully be limited to a particular venue will be brought in a court with jurisdiction where Purplexd is headquartered.

Nothing in this section prevents a customer from exercising consumer rights or using a venue that cannot legally be waived.

SECTION 25 — CHANGES TO THESE TERMS

We may update these Terms by posting a revised version on this page.

When required by law, we will provide notice of material changes. The “Last updated” date will show when the latest revision became effective.

Your continued use of the Services after an updated version becomes effective constitutes acceptance of the updated Terms to the extent permitted by law.
